Commercial Law Master Thesis Defense at Arab American University

Researcher Jihad Reda Kameel, Commercial Law student at AAUJ Faculty of Graduate Studies, defended his Master thesis titled “Arbitrator Civil Liability”.

The researcher addressed the arbitrator civil liability and mistakes made in performing the mission of dispute arbitration towards arbitration government parties and others, in a comparative study between Palestinian arbitration law, Jordan, Egypt and UAE, along with some foreign countries laws.

He pointed, the study found there are three approaches, one that refuses to question the felonies civil arbitrator accountable in comparison to judge in some countries, an approach that allows the arbitrator to be held accountable for all his professional mistakes and the third approach tries to reconcile the previous ones. The latter believes that the arbitrator can’t be questioned for his professional mistakes except in particular fraud and serious error cases. Explaining, the study urged the civil liability effects from civil penalties represented in isolating the arbitrator, invalidity and entitlement the arbitrator fees. Indicating, he came out with conclusions and recommendations on the arbitrator civil liability.

By end of discussion, the committee of Thesis Supervisor and head of the committee Dr. Yousef Shindi, Arab American University Internal examiner Dr. Bashar Daraghmeh and External examiner from An-Najah University Dr. Ghassan Khalid, decided to give the student Jihad Kameel a Master degree.
