The study’s problem statement lies mainly in the legal texts related to the individualization of punishment for economic crimes, whether contained in the Penal Code or in other laws, where the court is granted discretionary power. The difference between the two edges is often large, so that the judge’s discretionary power expands to face various circumstances surrounding the economic crime and its perpetrator.

The study dealt with the controls of the discretionary power of the criminal court judge in punitive individualization, comparing it to the relevant criminal legislation. This study is conducted in light of the powers granted to the criminal court judge due to the importance of clarifying the position of the Palestinian legislator in the Palestinian Criminal Procedure Law No. (3) of 2001 as well as the comparative legislation on the discretionary authority of the criminal court judge in punitive individualization in terms of the authority of the criminal court judge on the one hand.
